දත්ත ආරක්ෂණ පනත් කෙටුම්පත ගැන තරුණ ජනමාධ්‍යවේදීන්ගේ සංගමයෙන් එක්සත් ජාතීන්ට ලිපියක් !

යෝජිත දත්ත ආරක්ෂණ පනතේ අයහපත් ප්‍රතිපාදන ඉවත් කරමින් එය සංශෝධනය කිරීම සඳහා මැදිහත්වීමක් කර ශ්‍රී ලංකා රජයට දැනුම් දීමක් කරන ලෙස ඉල්ලමින් ශ්‍රී ලංකා තරුණ ජනමාධ්‍යවේදීන්ගේ සංගමය අදහස් දැක්වීමේ සහ ප්‍රකාශනයේ නිදහස පිළිබඳ එක්සත් ජාතීන්ගේ විශේෂ වාර්තාකරුගෙන් ඉල්ලීමක් කර තිබේ.

අධිකරණයක් නොවන ආයතනයකට දඬුවම් නියම කිරීමේ බලය ලබාදීම, තොරතුරු පනතේ ප්‍රතිපාදන හීන කිරීම සහ ජනමාධ්‍ය ක්‍රියාකාරකම් සීමා කිරීමට හේතුවන දත්ත ආරක්ෂණ පනත් කෙටුම්පත සංශෝධනය කරන ලෙස ඉල්ලමින් පාර්ලිමේන්තුවේ සියලුම මන්ත්‍රීවරුන්ට ලිපියක් යොමු කළ බව ද ශ්‍රී ලංකා තරුණ ජනමාධ්‍යවේදීන්ගේ සංගමය එක්සත් ජාතීන්ගේ විශේෂ වාර්තාකරුට යොමු කළ ලිපියේ සඳහන් වෙයි.

මෙම පනතේ ඇතැම් ප්‍රතිපාදන ආණ්ඩුක්‍රම ව්‍යවස්ථාවට නොගැලපෙන බවට වූ විශේෂ පෙත්සමක් ශ්‍රේෂ්ඨාධිකරණයට ඉදිරිපත් කළ බව ද, එම පෙත්සම ඉදිරිපත් කර ඇත්තේ දින 07ක කාලසීමාවට පසුව බවට නීතිපතිවරයා මතුකළ තාක්ෂණික කාරණය ගැන විරෝධය මත පෙත්සම නිශ්ප්‍රභා කළ බව ද එම ලිපියේ දැක්වේ.

To: UN Special Rapporteur on Freedom of Opinion and Expression

Dear Madam,

Re. Imminent rights violations through the proposed Data Protection Law in Sri Lanka

A draft law (bill) for Personal Data Protection was gazetted on 25^th November 2021 and tabled in parliament on 20^th January 2022. The English copy of the draft law is annexed herewith.

The gazette and draft bill came to our notice quite late and article 121 of the constitution provides only a week to challenge a draft bill that’s tabled in parliament at the Supreme Court. We attempted to challenge some provisions of the bill by e-filing a petition on 27^th January and filing a hardcopy petition on 28^th January, but both petitions were dismissed on technicality of being delayed.

Subsequently, we sent a letter to all Members of Parliament, Right to Information Commission, Human Rights Commission of Sri Lanka, the Attorney General and other relevant authorities about our concerns on 2^nd February 2022. The original letter in Sinhalese and an English translation is annexed.

In this letter, we have set out in detail our concerns and suggestions to improve the bill. Amongst the most serious concerns we have is that the draft law compromises rights of journalists, limits the enjoyment of right to information and grants powers to conduct inquiries and issue punishments by one and same institution that is not a court of law.

Unconfirmed information received by us indicates that the parliamentary debate on the draft law may happen on 22^nd February 2022 after which it is likely to be enacted as a law, which cannot be challenged in a Sri Lankan court.

We kindly request you to undertake an analysis of the draft bill and it’s implications on rights and rule of law and make interventions with the Sri Lankan government to prevent any harmful effects
