Case against Former Judge Mohan Peiris dismissed ; Technical errors – Bribery Commission
The Bribery and Corruption Commission informed the Colombo Magistrate’s Court yesterday (16) that steps will be taken to withdraw the case filed against three persons, including former Chief Justice Mohan Peiris, due to a technical error.
The Assistant Director General of the Bribery Commission, Subhashini Senanayake, appeared for the Bribery and Corruption Commission when the case was taken up before Colombo Chief Magistrate Buddhika Sri Ragala today.
Accordingly, the Magistrate ordered that the case be called on £0th March to confirm the facts.
The Legal Officer representing the Bribery Commission stated that the Supreme Court had issued a restraining order on the writ petition filed by the accused Mohan Peiris and his associates against the filing of the case.
However, the Legal Officer pointed out that the Supreme Court had yesterday given permission for the case to be heard.
However, the Legal Officer of the Bribery Commission informed the court that steps would be taken to withdraw the case due to a technical error.
Accordingly, the Supreme Court ordered that the case be called on 30th March for further submissions on the verdict.
The case was filed by the Bribery and Corruption Commission against Supreme Court Judge A.H.M.D. Nawaz, Former Secretary M.M.C. Ferdinando, and Former Chief Justice Mohan Peiris, accusing of committing an offense under the Bribery Act by failing to give proper instructions to take legal action against its chairman and other officials for irregularities in the purchase of a land in between 1st-30th December 2010 for the Ceylon Electricity Board (CEB) during the Yahapalana Government.
